Court orders Inspector-general of police to take possession of seized property

“Justice O. O. Tokode of the Federal High Court in Benin, has ordered the Inspector-General of Police to take possession of the immovable property situated at No. 1 Adesuwa Grammar School Road, GRA, Benin City.

Justice Tokode gave the order pursuant to a motion ex-parte dated and filed on the 28th day of June, 2017, with charge No. FHC/B/41C/2017, against a Benin-based legal practitioner, Dele Edokpayi and Circular Merchant Ltd as defendants over an alleged offence of forgery contrary to Sections 516 and 467 of the Criminal Code.

The prayers in the motion ex-parte moved by M.O. Omosun (Esq.), the said property seized by the Police during the arrest of the accused person would be determined pending the conclusion of trial of the accused person.

Granting the order, Justice Tokode stated that if the applicant continued with the business operation on the property during the pendency of the charge herein, the applicant shall deposit the proceeds in an interest yielding account for that purpose in a first generation bank in the name of the Inspector General of Police.

The motion also sought the court for such further order or orders it may deem fit to make in the circumstances of the case and was further supported by affidavit deposed to by one Adaghe Akomen of the Nigeria Police, zone 5 Headquarters, Benin City.”
